The Information Commissioner’s Office (ICO) has issued a statutory code of practice on data sharing. The new code will replace the previous data sharing code issued in 2011 under the Data Protection Act 1998.
The new code covers data sharing between data controllers (including data sharing as joint controllers). It does not deal with data sharing between a controller and its data processors. Points to note include the following:
Data sharing code of practice submitted to the Secretary of State on 17 December 2020. The Secretary of State will lay the code before Parliament. If, after 40 days, there are no objections the code will come into force following a further 21 days.
