France - E-merchants, don’t forget to update your T&Cs of sale!

A new French Decree on the legal guarantee of conformity of goods, digital content and digital services was published on June 30th, 2022.

A new French Decree no. 2022-946 on the legal guarantee of conformity of goods, digital content and digital services was published on June 30th, 2022 (the “Decree”).

The Decree revises and completes the regulatory provisions, including pre-contractual B2C information obligation, following the transposition of the EU directives on consumer warranties in late 2021 in French law.

The Decree, among other things, provides for a new specific mention relating to legal guarantees that should be included in B2C T&C of sale, presented in a sidebar (i.e. outlined textbox).

Any B2C online seller must make sure its T&Cs of sale are updated to reflect changes required by this decree. There is still some time, as the Decree will enter into force on October 1st, 2022.
