Jurisprudencia en Materia de Impuesto al Valor Agregado (IVA)

La Segunda Sala de la Suprema Corte de Justicia de la Nación ha emitido una jurisprudencia en materia de IVA que puede conducir a resultados no lógicos y no comerciales. Las empresas que operan en México deben ser conscientes de ello.

Generalmente, cuando una empresa realiza una actividad sujeta al IVA (enajenación de bienes, prestación de servicios, otorgamiento de uso y goce o importación de bienes o servicios), debe trasladar el IVA sobre la contraprestación. Ese IVA debe pagarse a las autoridades fiscales. El cliente puede acreditar el IVA trasladado con el IVA pagado o, en algunos casos, solicitar la devolución de dicho IVA. 

Por otro lado, la legislación mexicana permite la compensación de deudas. Sin embargo, la Suprema Corte ha determinado que cuando la compensación incluye el importe del IVA, no debe considerarse como pagado el IVA asociado.  Esto significa que, a pesar de la compensación, el "cliente" no puede acreditar el IVA contra el causado, ni solicitarlo en devolución. Esto sólo es posible cuando el cliente paga dicho IVA en efectivo, ya que la compensación no extingue la obligación de cobrar y pagar el IVA.

La decisión de la Suprema Corte tendrá efectos vinculantes una vez se publique. Las autoridades fiscales la aplicarán para denegar el acreditamiento del IVA en las declaraciones de IVA de los clientes, mediante el ejercicio de sus facultades de comprobación o, en su caso, para negar las solicitudes de devolución del IVA.

La interpretación realizada por la Suprema Corte se refiere a la Ley del Impuesto sobre el Valor Agregado vigente para los ejercicios 2019 y 2020, no obstante, sus efectos se trasladarán a ejercicios posteriores.
