Regla 2.1.52. de la Resolución Miscelánea Fiscal (“RMF”)

En la Regla 2.1.52. de la Resolución Miscelánea Fiscal para el ejercicio fiscal de 2023 (“RMF”) se establece la integración del órgano colegiado y sus reglas de operación.

La cláusula general antiabuso prevista en el artículo 5-A del Código Fiscal de la Federación (“CFF”) que desconoce para efectos fiscales los actos jurídicos que carezcan de razón de negocios no había sido aplicada por la autoridad fiscal-en ejercicio de sus facultades de comprobación- desde que entró en vigor (1º de enero de 2020)- en virtud de que para presumir que un acto carece razón de negocios la autoridad fiscal debe someter el caso ante un órgano colegiado que emitirá opinión positiva sobre la ausencia de esas razones de negocios. Al día de hoy ese órgano colegiado no había sido constituido y/o integrado por la autoridad fiscal; así como no se habían publicado sus reglas de operación.

En la Regla 2.1.52. de la Resolución Miscelánea Fiscal para el ejercicio fiscal de 2023 (“RMF”) se establece la integración del órgano colegiado y sus reglas de operación.

Ello es una clara señal que, para el ejercicio de 2023, la autoridad fiscal comenzará a ejercer facultades de comprobación para determinar si los actos jurídicos realizados en los últimos ejercicios fiscales carecen de razón de negocios.
